1. Eligibility: The “Give Us Your Best Indy” Contest (“Contest”) is only open to permanent legal residents
of the fifty (50) states of the United States (including the District of Columbia; excluding Guam, Puerto
Rico, and all other U.S. territories and possessions, and where prohibited), who are physically located
and residing therein and who have reached the age of majority in the jurisdiction in which they reside.
(For all purposes of this Contest, the age of majority is nineteen (19) years of age in Alabama and
Nebraska, twenty-one (21) years of age in Mississippi and Pennsylvania, and eighteen (18) years of age
in the remaining 46 states and the District of Columbia.) To be eligible, an entrant (“Entrant”;
sometimes referred to in these Contest Official Rules as “you”) must possess a valid Social Security
number or personal tax identification number issued in his/her name by the appropriate government agency.
Employees of CBS Studios Inc. (“Sponsor”), Paramount Pictures Corporation, the Contest administrator, their
advertising or promotion agencies, those involved in the production, development, implementation or handling
of the Contest, any agents acting for, or on behalf of the above entities, their respective parent companies,
officers, directors, subsidiaries, affiliates, service providers, prize suppliers, and any other person or
entity associated with the Contest (collectively “Contest Entities”) and/or members of the immediate family
(spouses, children, siblings, parents) of such persons, and/or persons living in the same household as such
persons, whether or not related, are ineligible to enter the Contest.
2. How to Enter: The Contest begins on or about April 8, 2008 at 12:00 noon Pacific Time (“PT”) and ends at
11:59:59 p.m. PT on April 16, 2008 (“Contest Period”). Pacific Time shall control for all purposes of this
Contest. Sponsor’s computer is the official time clock of the Contest. To enter the Contest:
a. Access the Contest web site at https://secure.etonline.com/indycontest/ (“Web Site”) and click on the
entry link, which will take you to the Contest entry form;
b. Follow the online instructions to complete and submit the Contest entry form in its entirety.
Information required on the entry form consists of your first name, last name, complete address (including
city, state, ZIP code; no P.O. Boxes), telephone number (including area code) where you can be reached on or
about April 21, 2008 between the hours of 10:00 a.m. PT to 1:00 p.m. PT, an alternate telephone number (including
area code), date of birth, and e-mail address. In addition you must check the boxes confirming the following:
that you are 18 years of age (for the purposes of this Contest that means that you must be a legal adult of the
age of majority under the laws of the jurisdiction in which you reside); that you are a permanent legal U.S.
resident; and that you agree to all terms and conditions set forth in these Contest Official Rules (collectively
“Entry Information”);
c. Enter your answer (“Answer(s)”) to each of the three (3) questions provided. Each Answer must be written
in the English language and consist of at least two (2) words, but no more than ten (10) words. The Answers will be
taken into account only if necessary to select the potential Contest winner as part of the tie-breaking procedures
set forth in Section 3 below. The questions are as follows:
1) Who played a young Indiana character in “Indiana Jones and the Last Crusade?”;
2) Who played Indiana Jones’ father in “Indiana Jones and the Last Crusade?”; and
3) How did George Lucas come up with the character name “Indiana?”;
d. Create one (1) original video of yourself, at least ten (10) seconds but not more than thirty (30) seconds in
length, which best demonstrates your impersonation of the Indian Jones character, “Indy” (“Video”). The Video cannot
include any person other than yourself. If Video exceeds thirty (30) seconds, then only the first thirty (30) seconds
will be judged. Video must be in one of the following formats and must not exceed 100 MB: Windows Media: .wmv /
Quicktime: .qt or .mov / Flash: .flv (On2 VP6 encoded) / avi: .avi / 3gpp: .3gp / mpeg1,2,4: .mpg, mpeg, .mpe, .m4v,
or .mp4;
e. Follow the online instructions to upload the Video. For your Video to be considered eligible in this Contest,
it must meet the following requirements. The Video: (1) must be at least ten (10) seconds but not more than thirty
(30) seconds in length (as noted above, if longer than 30 seconds, only the first 30 seconds will be judged); (2) must
be Entrant’s original creation that has never been previously published, performed or otherwise exhibited; (3) must be
responsive to the “Give Us Your Best Indy” directive; (4) must be in English; (5) must not contain the name, likeness
or voice of any person other than the Entrant, and must not refer to any real person other than the Entrant; (6) must
not contain or depict any objectionable, unlawful, defamatory, obscene, sexually explicit, threatening, abusive,
harassing, hateful, discriminatory, threatening, vulgar, racially or ethnically-motivated material, or material that
is invasive of another’s privacy, or any other objectionable material or gesture or material that is otherwise unfit
for publication/posting/uploading, as determined by Sponsor in its sole and absolute discretion; (7) must not violate
or infringe any copyright, trademark, privacy, publicity or other proprietary right of any person or entity and must
not contain, or otherwise make available any materials (images, sounds, music, trademarks, logos, etc.) that infringe
upon any personal, proprietary or any other right of any third party; (8) must not contain the last name, phone
number(s), address, or email address of any person, including the Entrant; (9) must not contain any visual or audio
references to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any depiction or representation thereof;
(10) must not contain or otherwise make available any unsolicited or unauthorized advertising, “commercial pitch,”
promotional materials, junk mail, spam, pyramid schemes, or any other form of solicitation; (11) must not contain or
transmit any materials that contain software viruses or other computer code, files or programs designed to impair,
limit, interfere with or cause harm to any communications network operated by any of the Contest Entities or the
computers of any individual or entity participating in or otherwise associated with this Contest; and (12) must not
contain any material that: (a) would give or threaten to give rise to criminal or civil liability; (b) encourages
conduct that constitutes a criminal offense; or (c) encourages or provides instructional information about illegal
activities.
In order to be considered an eligible Entrant in this Contest, the same one person must be the person who completes
and submits his/her own Entry Information, must be the account holder of the email address provided as part of his/her
Entry (defined below), must be the only person who appears as “Indy” in the Video, must be the person who submits the
Answers to the questions in Section 2.c. above, and must be the person who submits/uploads his/her Video. (The material
described in this paragraph constitutes the “Entry” or “Entries” when referred to collectively.) Entries must be
received by 11:59:59 p.m. PT on April 16, 2008. All required Entry Information must be completed in full. Proof of
delivery or receipt of any kind of submission (or portion thereof) will not be deemed by Sponsor as proof of submission
of an Entry. Entrant agrees and represents that, prior to his her entry in this Contest, he/she had all the tools
necessary to produce his/her Video (and did not purchase them for purposes of entering into the Contest). If an Entrant
elects to be videotaped by someone other than himself/herself (a “Videographer”), Entrant must have Videographer’s
permission to submit the Video to this Contest and Videographer will be required to complete documentation as outlined
in Section 6 below. If a Videographer is a resident of a jurisdiction where he/she is considered a minor, his/her parent
or legal guardian must provide the required permission(s) and complete the documentation on minor’s behalf. An Entrant
may only enter at the Web Site under one (1) email address. Once an email address has been used by an Entrant, that
email address cannot be used by any other person to enter the Contest. Limit one (1) Entry per person/per Entrant/per
email address during the entire Contest Period. Entries in excess of the stated limits by the same person will be
disqualified. Any attempted form of entry other than described herein is void. Each Entry will be judged on the
criteria set forth in Section 3 below. No entry by a group or organization will be considered. Any potential entry that
contains information that is not reasonably pertinent to the judging criteria (described below), as determined by
Sponsor in its sole discretion, or is otherwise in violation of these Contest Official Rules, will be disqualified. For
Entrant’s Entry to be valid and in order for his/her Entry to be considered, each Entrant must acknowledge reading,
accepting, and agreeing to all terms and conditions set forth in these Contest Official Rules. All Entry Information
and material submitted by an Entrant is subject to Sponsor’s Terms of Use located at http://www.cbsinteractive.com/info/tou.
3. Judging: All eligible Entries will be judged by Sponsor, who will determine the potential winner. Entrant’s Video
will be judged based on the following criteria below (collectively “Judging Criteria”):
a) Impersonation Ability (1-40 points);
b) Overall Look of Video (1-30 points); and
c) Added Creativity (1-30 points).
The maximum total number of points an Entrant can score on his her Video is one-hundred (100) points (“Video Score”).
The Entrant who receives the highest Video Score will be declared the potential winner, subject to compliance with these
Contest Official Rules. In the event of a Video Score tie, the tied Entrant who scored highest in the “Impersonation
Ability” criteria will be declared the potential winner. In the event of a further tie, the tied Entrant who scored
highest in the “Overall Look of Video” criteria will be declared the potential winner. In the event of a further tie,
the tied Entrant who scored highest in the “Added Creativity” criteria will be declared the potential winner. In the
event of any remaining tie, the tied Entrant’s total number of correct Answers will be added to the Video Score. Each
correct Answer is equal to 10 points (“Answer Points”). There are a total of thirty (30) total Answer Points possible.
The Video Score and correct Answer Points from each tied Entrant will be added together to create a final total score
(maximum of one hundred and thirty (130) points) (“Total Score”). In the event of a remaining tie, Sponsor will, as
necessary, re-score the tied Entries using the above criteria until the tie is broken and a potential winner is
determined.
4. Prize: One (1) Prize: There will be one (1) prize awarded, consisting of the following: One (1) trip for winner and
one (1) guest to New York, N.Y. to attend a screening of the film “Indiana Jones and the Kingdom of The Crystal Skull;”
roundtrip coach class airfare from a major commercial airport near winner’s residence to New York, N.Y. (airports
selected at Sponsor’s sole discretion); standard hotel accommodations for two (2) nights (standard room, double
occupancy); ground transportation to/from the airport and hotel in New York; ground transportation to/from the screening;
two (2) passes to the screening for winner and guest; and two hundred dollars ($200) for winner only, which may be paid,
at Sponsor’s discretion, as a hotel credit for incidentals (includes meals and beverages, but excludes alcoholic
beverages, spa services and gift shop) (“Trip”). Approximate Retail Value (“ARV”) of Prize is $3,300. WINNER AND GUEST
MUST BE AVAILABLE TO TRAVEL ON OR ABOUT MAY 20, 2008 THROUGH ON OR ABOUT MAY 22, 2008 (OR ON OTHER DATES AND TIMES
SPECIFIED BY SPONSOR AT ITS SOLE DISCRETION), OR WINNER WILL BE DISQUALIFIED AND AN ALTERNATE POTENTIAL WINNER MAY BE
SELECTED AT SPONSOR’S SOLE DISCRETION. Winner will not receive a refund or credit for any unused portion of the hotel
credit prize component. Particulars of airline, hotel and location of the screening to be determined by Sponsor at its
sole discretion. Winner and his/her guest must travel together on the same itinerary and must have valid travel documents
(including but not limited to valid government issued photo I.D.’s) and a credit card in good standing for hotel check
in and incidentals not included as part of the prize. Screening passes are subject to availability. Air transportation
provided only if winner resides more than 100 miles from destination. If winner resides within 100 miles of destination,
winner will be given three hundred dollars ($300), paid by check, in lieu of air transportation. Actual value of Trip
will depend on point of departure and any airfare fluctuations; any differences between actual value and ARV stated in
these Contest Official Rules will not be awarded. In the event that the screening does not or cannot take place as
scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, force
majeure, or for any other reason, then the remaining components, if any, of the prize shall constitute full satisfaction
of Sponsor’s prize obligation to the winner, and no other or additional compensation will be awarded. If the screening
is cancelled or postponed during winner's Trip for any reason, the screening portion of prize will be forfeited and
no additional substitute prize or compensation will be provided in lieu thereof. If the screening is cancelled or
postponed prior to booking, winner will have one (1) year from date of notification of winning to take Trip without
the screening portion of prize. Trip is subject to air travel and hotel availability, holiday and blackout dates, and
all other prize and travel restrictions. The prize restrictions/conditions stated herein are not all-inclusive and may
be subject to additional restrictions/conditions, which may be stated in the Affidavit/Release (described below) and/or
winner's travel documents. Once determined, no change, extension or substitution of a Trip date is permitted, except
by Sponsor at its sole discretion. Winner’s guest must be at least 18 years of age or older or the age of majority in
the jurisdiction in which he/she resides, as of April 8, 2008. If winner elects to partake in any or all portions of
his/her prize without a guest, no additional compensation will be awarded in place thereof. Winner is solely responsible
for all costs, incidentals, and expenses not specifically mentioned as being included, including but not limited to,
any unspecified air and ground transportation and/or accommodations, state and local fees, excursions, gratuities,
incidental expenses, drinks, unspecified meals, gratuities, security, airport fees, taxes, gasoline, and souvenirs,
licenses, registrations, telephone calls and fees or charges for changing dates. Neither trip insurance nor travel
insurance is included as part of the prize. No substitution, transfer, or cash equivalent for any prize (or prize
components) is allowed, except that Sponsor may substitute a prize (or prize component) with one of equal value for
any reason at its sole discretion. Prize notification and itinerary will be shipped to U.S. addresses only. All federal,
State, or other taxes are the sole responsibility of the winner. Winner will receive a 1099 form from the Sponsor for
the total ARV, as stated herein, of his/her prize that he/she won for the calendar year that he/she won. Sponsor will
not replace any lost or stolen tickets, passes, travel vouchers or certificates. Sponsor is not liable for any expenses
incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may
not qualify for frequent flyer miles. Winner and guest assume all risks and liabilities arising from participation in
this Contest and/or acceptance of any prize offered. Any depiction of prize or prize elements is for illustrative
purposes only.
5. Notification of Winner: On or about April 19, 2008, the Contest administrator will attempt to notify the potential
winner by telephone between the hours of 10:00 am PT and 1:00 pm PT at the phone number(s) provided in potential
winner’s Entry, to determine potential winner’s initial eligibility by use of a telephone eligibility questionnaire.
If potential winner cannot be reached by phone during such set time period or if he/she is found to be ineligible or
otherwise not in compliance with these Contest Official Rules, he/she may be disqualified and an alternate potential
winner may be selected.
6. Winner Requirements: Potential winner will be required to execute an Affidavit of Eligibility, a Liability Release,
(where legal) a Publicity Release, an IRS Form W-9, and any other documentation Sponsor may require (collectively
“Affidavit/Release”), which, among other functions, releases the Contest Entities from any and all liability as well
as contains, among other things, representations regarding the authorship of Entrant’s Entry and confirmation of the
grant of ownership of the Entry to Sponsor. The Affidavit/Release and IRS Form W-9 must be signed and faxed to the
Contest administrator, along with a legible copy of potential winner’s government issued photo I.D., within twenty-four
(24) hours of receipt. If applicable, winner will also be required to obtain from the Videographer who taped the Video
a written grant/release of rights as well as a Liability and Publicity Release (“Videographer Participation Release”).
If Videographer is a resident of a jurisdiction where he/she is considered a minor, his/her parent/legal guardian must
complete the documents on Videographer’s behalf. The Videographer (or his/her parent/guardian if a minor) must
complete and sign the Videographer Participation Release and fax it to the Contest administrator, along with a legible
copy of Videographer’s (and, if applicable, parent/guardian’s) government issued photo I.D. within twenty-four (24)
hours of receipt. In addition, winner’s travel guest will be required to execute a Liability and Publicity Release
(“Travel Guest Release”) and fax it along with a legible copy of his/her government issued photo I.D. to the Contest
administrator within two (2) business days of winner’s receipt. A faxed Affidavit/Release, Videographer Participation
Release and Travel Guest Release will have the same force as the original. Potential winner will then be required to
return the original Affidavit/Release, IRS Form W-9, Videographer Participation Release (if applicable) and Travel
Guest Release (along with legible copies of each person’s government issued photo I.D.(s)), and use the pre-paid FedEx
envelope provided within two (2) days of receipt, or such potential winner will be disqualified. By returning the
completed Affidavit/Release, IRS Form W-9, Videographer Participation Release, Travel Guest Release, government issued
photo I.D.(s), and all other documentation (as applicable) stated above, potential winner attests to the authenticity
of his/her Entry and the provisions stated therein including compliance with these Contest Official Rules. If potential
winner does not meet all of the above requirements, he/she may be disqualified and the Entrant whose eligible Entry
received the next highest score may be declared the potential winner, subject to verification and compliance with these
Contest Official Rules.
7. General Conditions and Disclaimers: The Contest is subject to all applicable federal, state, and local laws, and to
these Contest Official Rules (collectively “Rules and Laws”). The Contest Official Rules will be posted on the Web Site
during the Contest Period. By participating, Entrants agree to be bound by these Rules and Laws and the decisions of
the Sponsor, which are final and binding in all respects; to waive any right to claim ambiguity in the Rules and Laws;
to indemnify and hold harmless the Contest Entities from any and all liability resulting or arising from the Contest;
and to release all rights to bring any claim, action, or proceeding against the Contest Entities. Entrants hereby
acknowledge that said Contest Entities have neither made nor are in any manner responsible or liable for any warranty,
representation or guarantee, express or implied, in fact or in law, relative to any prize. The Contest Entities are
not responsible or liable for multiple attempted entries or entries that are entered by other than human means or
attempted entries that are late, incomplete, lost, misdirected, forged, damaged, destroyed, tampered with, or otherwise
not in compliance with these Contest Official Rules, and all such entries will be disqualified. The Contest Entities
are not responsible for incorrect or inaccurate transcription of Entry Information, and/or incomplete upload of Entry
or other Entry Information. If, for any reason, the Contest is not capable of running as originally planned, Sponsor
at its sole discretion, reserves the right to cancel, suspend or modify the Contest or any portion(s) thereof and
conduct the judging from among all salvageable eligible Entries received, if any. Any person attempting to defraud
Sponsor or tamper with the Contest in any way will be prosecuted to the full extent permitted by law and will not be
eligible for a prize. Once submitted, Entries become the sole property of Sponsor and may not be acknowledged and
will not be returned. By entering the Contest, each Entrant represents to Sponsor that his/her Entry is wholly original
and his/her own creation, and that the Entrant is the sole owner of all rights (other than Sponsor) relating to all
contents of his/her Entry. Each Entrant agrees to indemnify and hold harmless the Contest Entities from any and all
liability resulting or arising from use of any Entry. In case of a dispute over the identity of an Entrant, the
authorized account owner of the email account associated with that Entry may be deemed the sole eligible Entrant,
at Sponsor’s sole discretion. “Authorized account holder” of an email address is defined as the natural person who
is assigned to an email address by an Internet Access provider, on-line service provider, or other organization that
is responsible for assigning email addresses for the domain associated with the submitted email address.
8. Grant of Rights: Each Entrant (and each Videographer, if applicable) unconditionally assigns and transfers all rights,
title, interest, claim, ideas, concepts, copyrighted materials and trademarks contained in the Entry and any and all
rights including “moral rights” in the Entry to the Sponsor. Entrant (and each Videographer, if applicable)
unconditionally assigns and transfers to Sponsor all rights, title, interest, and claim, which he or she now has, or
may in the future have to his/her Entry. Sponsor has the right to use, assign, modify, edit, adapt, dispose of, and
electronically alter any Entry, for any legal purpose including, but not limited to, moral rights, for use in
promotional and/or commercial materials, as well as to reproduce any Entry, in whole or in part, without compensation
or additional consent from winner, Entrant, Videographer (if applicable) or any other third party. Sponsor will not
provide any personally identifying information of minors, regardless of its source, to any third party without the
express written consent of minor’s parent/legal guardian.
9. Publicity Release: Notwithstanding anything to the contrary in Sponsor’s Privacy Policy located at
http://www.cbsinteractive.com/info/privacy except where prohibited by law, participation in the Contest and/or
acceptance of a prize constitutes permission for Sponsor to use, without notice or further compensation, in all
media currently know or hereafter devised, worldwide and in perpetuity, any and all portions of an Entry including,
without limitation, the Entrant’s Video, Answer(s), name, address (city and state), photo, likeness, biographical
information, statement and voice for any purpose including, without limitation, advertising and promotional purposes
as well as in, on or in connection with “Entertainment Tonight,” the Trip, the screening, the Web Site, the Contest,
or other promotions, and a release of the Contest Entities from any liability whatsoever with respect thereto.
10. Disclaimers: By participating, Entrants agree that the Contest Entities shall have no responsibility or liability
(including, but not limited to, liability for any property loss, damage, personal injury or death, as well as claims
based on publicity rights, defamation, and/or invasion of privacy) in connection with this Contest, including
participation in this Contest or the acceptance, receipt, possession, misuse, nonuse or use of the prize (or portion
thereof) including, but not limited to, ambiguous entry questions and/or disputes over answers to entry Answers,
acceptance, use or misuse of the Trip or any prize component awarded herein (including, but not limited to,
cancellations and delays or any change by the air carrier(s) or other company or any other persons providing any
service for the winner and his/her guest during the Trip due to reasons beyond control of Sponsor and/or the Contest
Entities); human error; any technical malfunctions of the telephone network, computer online system, Video upload or
record functionality, Video playback, computer date/time mechanism, computer equipment, software, or internet service
provider utilized by the Contest; interruption or inability to access the Web Site, or any online service via the
internet due to hardware or software compatibility problems; any damage to Entrant’s (or any third person’s) computer
and/or its contents related to or resulting from any part of the Contest; any lost/delayed data transmissions,
omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of one of
the Contest Entities; and waives all rights to claim direct, indirect, punitive, incidental and/or consequential damages,
attorney fees or any damages other than actual out-of-pocket costs incurred to enter this Contest. The Contest Entities
shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be
caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of the prize
suppliers or any of their agents, servants, employees or independent contractors, or on the part of any entity or person,
or (2) by any other cause, condition or event whatsoever beyond the control of Sponsor and other Contest Entities.
Entrants agree to release all rights to bring any claim, action, or proceeding against the Contest Entities.
11. Nature of Relationship/Waiver of Equitable Relief: Each Entrant (and Videographer, if applicable) hereby
acknowledges and agrees that the relationship between the Entrant and the Contest Entities is not a confidential,
fiduciary, or other special relationship, and that the Entrant’s decision to provide his/her Entry to Sponsor for
purposes of the Contest does not place the Contest Entities in a position that is any different from the position
held by members of the general public with regard to elements of the Entrant’s Entry. Each Entrant and Videographer
(if applicable) understands and acknowledges that the Contest Entities have wide access to ideas, stories, designs,
and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own
employees. Each Entrant and Videographer (if applicable) also acknowledges that many ideas or stories may be competitive
with, similar or identical to the Entry and/or each other in theme, idea, plot, format or other respects. Each Entrant
and Videographer (if applicable) acknowledges and agrees that such Entrant will not be entitled to any compensation
as a result of any Contest Entity’s use of any such similar or identical material. Each Entrant and Videographer
(if applicable) acknowledges and agrees that the Contest Entities do not now and shall not have in the future any
duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or
protection of the copyright in and to the Entry.
