A judge has granted a preliminary injunction for HOWARD K. STERN preventing a Texas doctor from distributing an alleged 1994 video recording of the late ANNA NICOLE SMITH getting breast augmentation surgery, according to The Associated Press.
In court papers obtained by ET, Stern -- the executor of Anna's will -- alleges that GERALD WAYNE JOHNSON, M.D. videotaped the surgery without Smith's consent, violating several state and federal laws.

"I'm not allowed to have lipo, I'm not allowed to have a facelift -- which I'd really like to have -- I am not allowed to have an eye job, I'm not allowed to have a boob job, I'm not allowed to have anything. I knew going into it that this was 'what you see is what you get.' It has to be natural."
On last Sunday night's episode of "GENE SIMMONS Family Jewels," the 57-year-old KISS frontman went under the knife for a facelift for the second season of the show, airing Sunday nights at 9 and 9:30. On the upcoming episode, Simmons, who is known as the "Demon," becomes the "Mummy" as he is wrapped in bandages for his recovery.
"You feel like you've been beaten up, but because of the drugs, you can't feel the pain, but you know you're in bad shape," says the rocker, who checks out of the hospital and returns home.
When GENE SIMMONS' producer on his A&E reality series, "Gene Simmons Family Jewels," suggested that the 57-year-old KISS frontman go under the knife and have a facelift for the second season of the show, airing Sunday nights at 9:30, his live-in love SHANNON TWEED was right with him.
The former Playboy Playmate tells ET her response was, "You are not going to have a facelift by yourself and look younger than me."
