Halle Berry has pulled out of a movie in order to go to court for custody of her young daughter.
People magazine reports that Berry is preparing to go to court against ex Gabriel Aubry over custody of their daughter, Nahla, 2. Berry gave up her role in the film 'New Year's Eve' in order to be available for litigation and was replaced by Katherine Heigl, People reports.
Berry's rep tells People, "Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her."
The rep says that Berry has attempted to resolve custody issues with Aubry "amicably" but " given his lack of cooperation, Halle has no choice but to seek swift judicial intervention."
Gabriel filed a petition for custody late last month, asking for joint physical and legal custody of Nahla.
