Kim Kardashian's Instagram Post Promoting Morning Sickness Pill Called 'False or Misleading' by FDA

The 34-year-old reality star, who is pregnant with her second child with Kanye West, 38, received a warning letter from the Food and Drug Administration, after an Instagram post she made last week appeared to promote the morning sickness medication, Diclegis.

In the since deleted post (although the tweet linking to it remains, for now) Kim wrote, "OMG. Have you heard about this? As you guys know my #morningsickness has been pretty bad, so I talked to my doctor. He prescribed me #Diclegis, I felt a lot better and most importantly, it's been studied and there was no increased risk to the baby."

"I'm so excited and happy with the results that I'm partnering with Duchesnay USA to raise awareness about treating morning sickness," she continued.

Kim's rep confirms the reality star wrote the post with the drug company, Duchesnay, which they signed off on. In a letter obtained by ET, the FDA calls Kim's post "false or misleading," adding that it "fails to communicate any risk information associated with its use and it omits material facts."

ET reached out to an FDA spokesperson about the warning letter, who replied with the following:

"This is an open compliance matter, which means that we will not state our intentions regarding Duchesnay," the spokesperson said.

"However, as a general matter, A Warning Letter is an advisory and not a final agency action. The Warning Letter is the company’s notification that we found what appears to be violations to the Federal Food Drug and Cosmetic Act. But, the company is allowed to either make the appropriate corrections or present its rationale for disagreeing with our findings. Companies that do not correct citations in warning letters, or show that those citations are unfounded, risk enforcement action such as seizure, injunction, or civil money penalties."

Kim posted a totally nude Instagram on Tuesday, revealing her pregnancy curves, along with a message to put to bed rumors she is using a surrogate.

"First they say I'm too skinny so I have to be faking it...Now they say I'm too big so I have to be faking it...SMH!" she wrote. "Some days I'm photographed before I eat & look smaller, some days I've just eaten & I look bigger. It's all a part of the process. I think you all know me well enough to know I would document the process if I got a surrogate."

Kim revealed that she and Kanye are expecting a boy in June, with a picture, and the caption, "Precious moments like this when we were traveling on tour with you are what I live for. You're such a good daddy to North & you will be the best daddy to our new son too!"
