It was revealed on Wednesday that Johnny Depp and Amber Heard are divorcing, which could mean a custody battle over their dogs. However, a source tells ET that Pistol will most definitely live with Heard.

"Her ex-girlfriend Tasya [van Ree] gave her the dog, so of course she will keep him," the source said. "Tasya was Amber’s only other long-term partner."

As for Boo, the source thinks that pup may also go to Heard, as the Magic Mike XXL star may gotten him before she married Depp.

In the state of California, where Heard filed for divorce, pets are considered personal property under state property laws.

The two pooches started making headlines when Heard smuggled them into Australia while Depp was filming a Pirates of the Caribbean sequel there. Last month, the 30-year-old actress pleaded guilty in court to making a false statement on her immigration card and illegally bringing Pistol and Boo into the country. Heard and Depp, 52, also recorded a sincere apology video.

“Australia is a wonderful island with a treasure trove of unique plants, animals and people,” Heard says in the clip.

“It has to be protected,” Depp adds.
