ET has obtained court papers related to Wednesday's hearing in the BRITNEY SPEARS and KEVIN FEDERLINE custody battle.
On Wednesday, a Los Angeles judge ordered that while both Britney and Kevin will share custody, Kevin will have primary custody of SEAN PRESTON, 2, and JAYDEN JAMES, 1, while Britney will have monitored visitation.
Regarding custody, the papers state, "The minor children shall remain in the custody of [Kevin] with the exception of those specific dates and times as ordered by the Court in the transcript of the proceedings."
"Pending the further order of the Court, all visitation with [Britney] shall be in the presence of a monitor. … The monitor shall terminate visitation immediately if any conduct or action by [Britney] endangers the minor children."
Furthermore, according to the papers, Britney did not fully comply with a September 17 hearing that required drug testing and more stipulations. The papers read, "[Britney] offered evidence of compliance with a number of the specific orders made by the Court on September 17, 2007. However the Court finds that … [Britney] was not in substantial compliance with the material provisions of the Court's September 17, 2007, order."
Regarding drug testing, the Court says in the papers, "The Court expressly indicated that a missed test, refusal to submit to a test, or failure to respond to the testing agency's call as specified in the September 17, 2007, order shall be deemed by the Court as a failed test."
