ET confirms that RICHIE SAMBORA was arrested Tuesday night by Laguna Beach police on suspicion of driving under the influence.

The BON JOVI guitarist recently pulled a stint at Utah's Cirque Lodge in September.

According to Laguna Beach Police, Richie was pulled over at approximately 10:52 Tuesday night driving a black Hummer when he was spotted weaving within traffic lanes.

According to the police report, the officer smelled alcohol and conducted field sobriety tests to determine if the rocker was under the influence. He refused a breathalyzer and opted for the blood test back at the station -- the results are pending.

Richie was released at 4:00am this morning. A court date has been set for May 7. KEN SUNSHINE, a spokesperson for Bon Jovi, has no comment.

Additional information from Sergeant JASON KRAVETZ indicates that there was a female passenger in the vehicle at the time. Police turned the car over to her at the time of the arrest.
