Denise Richards asked a Los Angeles judge to change her child custody agreement with ex Charlie Sheen today but was denied, and will reportedly re-file with a different judge on Monday, Sheen's attorney tells ET.

Sheen and his primetime TV sitcom, "Two and a Half Men," were nominated for Best Actor and Best Comedy Emmys today. Richards is the star of E! reality show: "Denise Richards: It's Complicated."

Sheen's attorney tells ET: "It is most unfortunate that Denise Richards and her attorney are desperately trying to deprive Charlie Sheen of visitation with his children, and at the same time obviously trying to create a media circus designed to help publicize her reality show."
