A lawyer for Ed McMahon says the TV icon has settled a malpractice claim against Los Angeles' Cedars Sinai Medical Center, according to the Associated Press. Read on for details…
McMahon, 86, filed the lawsuit last July after claiming he broke his neck when he fell in March of 2007 at the home of Robert Day, an investor. After the fall, he alleges that the hospital failed to diagnose his neck fracture, and then subsequently botched two operations on his spine.
Citing McMahon's lawyer, the AP reports that the premises liability allegations against the owner of the home remain to be tried.
His lawyers are also seeking a ruling from a Los Angeles Superior Court judge that would prevent Robert and his wife Kelly's legal team from mentioning the settlement when a jury hears the claims against the investor and his spouse, says the AP.
"There is a significant danger that the Day (lawyers) will attempt to imply to the jury that (McMahon) has already been sufficiently compensated...," McMahon's lawyers stated in court papers, according to the AP.
The trial is scheduled for May 27.
