Larimer County Sheriff Jim Alderden appeared on Fox News' "The O'Reilly Factor" on Monday night and discussed the latest on the "balloon boy" controversy.
Sheriff Alderden said that if they are convicted in the future, Richard and Mayumi Heene could avoid jail time because this would be their first offense in Colorado.
He added that he believes the couple is liable for "criminal activity" and were motivated by wanting to land a TV show. He also said charges will likely be filed sometime next week.
"That's why the public is so upset…because they emotionally bought in to this," Alderden said about the public's interest in the story.
As for any potential restitution sought out, Alderden said he "heard figures" estimated at $2 million from the FAA because of diverted and delayed flights.
