The Santa Monica Police Department told ET that Judson Birza was arrested around noon on Wednesday.

The "Survivor" million dollar winner was "detained for a vehicle code violation" when an officer apprehended him for skateboarding in the middle of the street. It was discovered that there was a warrant out for his arrest for a prior incident, in which he is suspected for driving under the influence. Further, he is on probation for a DUI.

"During the time the officer was with him, the officer determined he was under the influence for a controlled substance and placed him under arrest for the open charge of being under the influence and a probation violation, along with the outstanding warrant," Sergeant Louis told ET. Test results will show what substance was in his system, but no such conclusions have yet been drawn.

Birza is being held on $37,000 bail and is scheduled to appear in court on Thursday morning. He won "Survivor: Nicaragua" just one month ago.
