Jon Gosselin is reportedly planning to sue his ex-wife Kate for primary custody of their 9-year-old sextuplets.

Jon tells the current issue of In Touch magazine that he wants custody of the kids -- Aaden, Alexis, Collin, Hannah, Joel and Leah -- to give them a chance at a normal childhood.

"They live in fear of Kate. Every time I see them, they tell me they want to live with me," he tells the magazine.

"First, I'm going to file for an emergency petition for contempt ... The next step is to fight for custody," Jon told In Touch, adding that he plans to file as soon as he saves enough money for lawyers and paperwork fees. "It's the only way I can protect the younger six."

Jon claims that Kate violated the current custody agreement by not giving him the option of watching the younger six kids when she recently took 13-year-old sisters Mady and Cara out of Pennsylvania to New York to appear on the Today show.
