"We are cooperating fully with the authorities, and are confident that we will be fully vindicated. We will have no further comment," Ken Sunshine, Weinstein's rep, said in a statement.
According to reports, a 22-year-old woman is claiming that Weinstein, 63, persuaded her to meet him at his Manhattan office under the pretext that they were to talk business.
"It was being investigated by the police department but at this time it is now with the Manhattan District Attorney's office to see where it is going to proceed to," the New York Police Department confirmed to ET on Tuesday.
On Monday, New York Daily News came out with a report claiming that a police source told them that the woman said Weinstein "asked if her breasts were real before touching them." The source goes on to say the alleged victim "asked him to stop, and he put his hand up her skirt. He asked for a kiss; she responded 'No.'"
Weinstein has been married to Marchesa fashion designer Georgina Chapman, 38, since 2007, and they have a two-year-old son and a four-year-old daughter together. He has three older children from his first marriage to Eve Chilton Weinstein, whom he divorced in 2004.
The acclaimed producer is the co-founder of Miramax and the co-chairmen of The Weinstein Company. He is responsible for producing numerous hit movies including Pulp Fiction, Shakespeare in Love -- which won an Oscar for Best Picture in 1999 -- and Gangs of New York.
