Kelly Rutherford's Famous Friends React to Her Custody Battle Win
By Jackie Willis
Kelly Rutherford's two children, son Hermes, 8, and daughter Helena, almost 6, are coming back to America to be with their mother.
After a long legal battle, a California judge ruled Friday that the Gossip Girl actress be given temporary sole legal and physical custody of her kids. The children's father, Daniel Giersch, must bring them back to Los Angeles, Calif. from Monaco, where they've been living since 2012, and Rutherford will keep their passports, People reports.
"Ms. Rutherford is extremely grateful for the decision rendered by the California Court and is looking forward to being reunited with her children," Rutherford's lawyer David Glass said in a statement sent to ET. "We are now focusing all of our energies on obtaining the return of the children from Ms. Giersch."
A hearing at the L.A. superior court -- which Rutherford, Giersch and their children are to attend -- has been set for June 15.
Rutherford, 46, filed for divorce in 2009, when she was three months pregnant with Helena. Her kids have been living with Giersch in Monaco since 2012 after his work visa was revoked, barring him from entering the U.S. A California judge ruled in Giersch's favor, ordering that the children should live with him in France, and Rutherford has been fighting the decision ever since.
This recent good news for Rutherford comes just weeks after she got her famous friends (Kim Kardashian, Kris Jenner and her Gossip Girl co-stars) to help her land 100,000 signatures on a petition to help get her kids back to the States. When a petition reaches 100,000 signatures, it must be reviewed by the White House.
